FULL TERMS AND CONDITIONS

 

1 BASIS OF CONTRACT

The making of a booking constitutes an offer by you to let the Property from R Link and C Freeman in accordance with these Terms and Conditions. Your booking shall only be deemed accepted upon receipt of the deposit and written acceptance of the booking by us and on which date a contract shall come into existence (the “Contract”). The Contract and any documents referred to in it will constitute the entire agreement between us. This Contract shall be governed by and construed in accordance with English law and subject to the exclusive jurisdiction of the English Courts.

This Contract is made for the purpose of a holiday and is not intended to create the relationship of landlord and tenant between us.

 

 

2 PAYMENT

A booking deposit of £100  is payable if the booking is made more than one month before the date the Holiday Period commences (“Commencement Date”). The balance of the Booking Price is payable one month before Commencement Date. Non-payment of the balance of the Booking Price on or before the due date shall be construed as a cancellation of the Contract by you. For bookings made less than one month before the Commencement Date, the Booking Price is payable on booking.

 

 

3 CANCELLATION

Any cancellation made by you for whatever reason shall be in writing and addressed to Rebecca Link, Morrel’s, 34 Lake Road, Keswick CA12 5DQ or email info@morrels.co.uk. We will endeavour to re-let the Property.

If we are unable to re-let, the full balance owing will remain payable by you or the monies paid will be forfeited (as applicable) and the deposit will not be refunded.

If we only succeed in re-letting the Property for part of the Holiday Period we shall refund an amount equal to the money paid less the rental for the period which is not re-let. If we have to reduce the price for a last minute let, we will refund the amount realised, less the deposit.

We strongly recommend that you take out Cancellation Insurance.

4 CHANGES OF DATE

We may at our discretion agree to change the dates of the Holiday Period upon receipt of a written request from you. If the dates of the Holiday Period are not changed the booking will remain in place and all monies will remain due.

 

 

5 PERIOD OF HIRE

Is from 3pm on arrival date until 10am on departure date.

 

 

6 USE OF PROPERTY

The number of persons occupying the Property must not exceed 6 in apartment One and 4 in apartment Four. The Property will be used for personal and domestic purposes only. The property shall not be used for any commercial purposes without our written consent. We reserve the right to refuse entry to the entire party if these conditions are not observed.

 

 

7 COMPLAINTS

Should there be any cause for complaint during the occupation of the Property it must be notified promptly to us and in case of serious problems confirmed in writing.

 

 

9 BREAKAGES OR DAMAGE

In the event of breakages, damage or the need for additional cleaning you shall reimburse us for replacement, repair or extra cleaning costs incurred. You will be invoiced for this and informed in writing. If the damage is such that the property becomes unfit for the next rental, we will charge you the cost of finding alternative accommodation for the next party, or refunding their money. We reserve the right to charge the debit or credit card details that we hold.

If the Property becomes unavailable or unusable for some reason prior to the date of a booking, then our obligation will be to (1) use our best endeavour to find a suitable alternative property, or failing which (2) to reimburse you for any monies paid. Occasionally, problems mean that some facilities or services become unavailable, and if this is the case we will tell you as soon as reasonably practical after we have been made aware of the situation.
